We recently discovered a fake lab report issued for cyanide in apricot kernels. The unusual certificate was noticed by the Canadian Food Inspection Agency (CFIA). The discrepancy on the certificate was difficult to detect – the version number of the certificate was in a very tiny font and a small box in an inconspicuous place on the report. Should this occur to your company you are strongly encouraged to report the fraudulent certificate to the Certifying agency, in this case it was BRC. Be warry! Today is the launch of the 20th annual Rail Safety Week. This national event is vital in raising public awareness of safety around railway property and trains. The U.S. Environmental Protection Agency (EPA) is kicking-off the 25th Pollution Prevention (P2) Week with a series of events and activities to advance practices that reduce, eliminate or prevent pollution at its source.

The California Food Safety Act. – Existing law provides for the regulation of the safety of food products, including adulterated and misbranded food, wholesale food, and food in retail food facilities. This bill, commencing January 1, 2027, would prohibit a person or entity from manufacturing, selling, delivering, distributing, holding, or offering for sale, in commerce a food product for human consumption that contains any specified substance, including, among others, brominated vegetable oil and red dye 3. The bill would make a violation of these provisions punishable by a civil penalty not to exceed $5,000 for a first violation and not to exceed $10,000 for each subsequent violation, upon an action brought by the Attorney General, a city attorney, a county counsel, or a district attorney. The Food and Drug Administration (FDA) is announcing that a proposed collection of information has been submitted to the Office of Management and Budget (OMB) for review and clearance under the Paperwork Reduction Act of 1995. Submit written comments (including recommendations) on the collection of information by October 18, 2023. The U.S. Department of Agriculture’s (USDA) Animal and Plant Health Inspection Service (APHIS) is seeking comments on a proposed rule to amend regulations governing its Agricultural Quarantine and Inspection (AQI) program user fees. APHIS and the U.S. Department of Homeland Security’s Customs and Border Protection (CBP) jointly administer the AQI program, which assures that cargo and passenger baggage entering the country is inspected for plant pests and potential sources of animal diseases that could affect U.S. agriculture, trade and commerce. Foreign pests and diseases can be devastating to U.S. agriculture and the broader U.S. economy, and the AQI program is highly successful at preventing such disruptions. The Food Safety and Inspection Service (FSIS) of the US Department of Agriculture has developed an innovative method for beef muscle samples that uses modern chemistry instrumentation for quantifying chemical residues. The U.S. Environmental Protection Agency (EPA) is proposing to amend the General Provisions for National Emission Standards for Hazardous Air Pollutants (NESHAP) to address applicability and compliance issues resulting from the addition of a compound to the list of hazardous air pollutants (HAP) under the Clean Air Act (CAA). This action focuses on issues related to newly applicable standards for sources that become major sources solely from the addition of a compound to the CAA HAP list. This action also includes a discussion of the impacts of a newly listed HAP on the federal operating permit program. Comments must be received on or before November 13, 2023. The U.S. Department of Transportation Federal Motor Carrier Safety Administration (FMCSA) has removed FALCON ELD and KSK ELD from the list of registered Electronic Logging Devices (ELD). FMCSA has placed these ELDs on the Revoked Devices list due to the providers’ failure to meet the minimum requirements established in 49 CFR part 395, subpart B, appendix A, effective September 14, 2023. Australia is announcing an extensive suite of proposed changes to categorisation, reporting and record-keeping obligations. Registered importers and manufacturers as well as interested stakeholders are invited to take part and have their say.
