As the assessment of the Canadian market determined that the domestic production capacity of alcohol-based hand sanitizers is currently stable, as of January 15, 2021, Health Canada will cease accepting new applications for hand sanitizers through this interim measure. From this date, Health Canada will revert to the standard, pre-COVID-19, regulatory process for the manufacturing and/or importation of these products.
Companies seeking to conduct activities related to hand sanitizer products, should pursue the relevant licences for these products and related establishments.
Notification forms for hard surface disinfectants will continue to be accepted under this interim measure until the regular supply of these products stabilizes. Health Canada will monitor the supply and demand of hard surface disinfectant and hand sanitizer products in Canada and will communicate all changes regarding the market landscape, as necessary.

Following the temporary suspension announced in May 2020 due to COVID-19, Global Affairs Canada has now resumed Phase II of the Review, which gives stakeholders an opportunity to provide their views on TRQ allocation and administration policy options for supply-managed products. The input received from Phase II of the consultations will inform the decisions of the Minister of Small Business, Export Promotion and International Trade in developing long-term TRQ policies. The long-term allocation and administration policies of each TRQ will be published on September 1, 2021.
Some Safe Food for Canadians (SFC) licence holders will need to take action today, January 15, to ensure they renew their licence before it expires. If your licence expires, your business will no longer be permitted to conduct licensed activities in accordance with the Safe Food for Canadians Act and may be subject to enforcement actions and removal from export eligibility lists. You will then need to apply for a new licence and be issued a new licence number, which may further disrupt your business activities including the ability to request export certification.

The penalty information included in this memorandum is intended to supplement the penalties and debt collection information found in Chapter 6 of the Field Operations Manual (FOM). Tables included in this memorandum reflect penalty amounts for calendar year 2021 and correspond to adjusted penalty amounts found in Occupational Safety and Health Administration (OSHA) Information Systems (OIS). OSHA updates this information annually to ensure access to current penalty information.
January 14, 2021 – The U.S. Environmental Protection Agency (EPA) met a major chemical safety milestone by releasing the final risk evaluation for C.I. Pigment Violet 29 (PV29) under the Toxic Substances Control Act (TSCA). Under TSCA, the nation’s primary chemical management law, EPA is required to evaluate the risks associated with existing chemicals in commerce using the best available science and then take action to address any unreasonable risks identified. Today’s final risk findings complete the risk evaluation process required by TSCA for PV29 and marks the completion of the risk evaluation process for all the first 10 chemicals.
January 12, 2021 – The U.S. Environmental Protection Agency (EPA) released its 2019 Toxics Release Inventory (TRI) National Analysis, which shows that EPA and companies that manage chemicals continue to make progress in preventing pollution. The report shows that between 2018 and 2019 total releases of TRI chemicals decreased by 9 percent.
January 12, 2021 – The U.S. Environmental Protection Agency (EPA) and the Occupational Safety and Health Administration (OSHA) announced a Memorandum of Understanding (MOU) that advances collaboration and communication on EPA’s review of new chemicals under the Toxic Substances Control Act (TSCA). This MOU provides a framework for coordination and communication between the two agencies on exposure to new chemicals in the workplace and will help achieve the agencies’ shared goal of ensuring workers are protected from potential health and environmental risks.
